Terms and Conditions of the Store

I. General Provisions

This document constitutes the General Terms and Conditions (“Terms”) for the purchase of products (“Goods”) offered by Qule.

II. Scope of Application

By purchasing Goods, you accept and agree to be bound by these General Terms and Conditions. Additionally, any posted guidelines or policies related to these products apply. Participating in the purchase process automatically signifies acceptance of these Terms by the Buyer. If you, as the Buyer, do not agree to comply with these rules, please refrain from purchasing our products.

Please read these Terms before placing an order for Goods in our company. These Terms apply to all purchases of Goods. Our company reserves the right to change the Terms at any time. The date of each update is indicated at the end of these Terms.

III. Definitions

For the purposes of these Terms, the following definitions apply:

  • “Company” – QULE Sp. z o.o.,

  • “Seller” – interchangeably used with the term “Company.”

  • “Buyer” – any individual, company, or legal entity purchasing Goods from the Company.

  • “Entrepreneur with Consumer Rights” – an individual entering into a sales agreement directly related to their business activity, where the content of the agreement indicates it does not have a professional character for this Entrepreneur, as determined particularly by the subject of their business activity made available under the provisions of the Central Register and Information on Business Activity.

  • “Terms” – these General Terms and Conditions.

  • “Goods” – any products delivered to the Buyer by the Company.

  • “Delivery Date” – the date Goods are delivered in accordance with the Buyer’s order and prior agreement with the Company.

  • “Agreement” – any contract for the sale and purchase of Goods between the Company and the Buyer, including these Terms.

IV. General Provisions

  1. The Buyer declares that the information provided when placing an order is sufficient and up-to-date to fulfill the order.

  2. The Buyer declares that they have the legal capacity to enter into the agreement. The Buyer may not assume any warranty, obligation, or other liability on behalf of the Seller, supplier, licensor, or manufacturer of the Goods without prior written consent from the Seller.

  3. Qule employees are not authorized to make any representations regarding the Goods. Any such statements must be confirmed in writing by the Seller. By entering into the Agreement, the Buyer waives all claims arising from unauthorized statements.

  4. Any changes to these Terms require prior written consent from both the Buyer and the Seller.

  5. The Seller reserves the right to change prices and other documents related to the Goods without prior notice. These changes cannot be treated as an offer to sell the Goods.

  6. The Seller’s liability to the Buyer for breach of any of these Terms is limited to refunding payments made for undelivered or returned Goods within the agreed timeframe and under the required conditions. The Company is not liable for any other losses or damages.

  7. If any defects are found in the ordered Goods, the Seller will inform the Buyer as soon as possible.

  8. Information provided by the Company does not replace medical or professional advice. The Company makes every effort to ensure the information on its website is as accurate as possible but is not responsible for inaccuracies.

V. Delivery Costs

Delivery costs depend on the destination country and the weight of the package. Shipping costs range from 10.99 GBP to 36.49 GBP. Free shipping may also be available if specific promotional conditions or minimum order amounts are met, as published on the store’s website. Exact delivery costs are calculated during the ordering process.

VI. Right to Withdraw from the Agreement

  1. The Buyer, being a Consumer or Entrepreneur with Consumer Rights, has the right to withdraw from the agreement in writing without giving a reason within 14 (fourteen) days from the date of entering into the agreement, in accordance with the Act of May 30, 2014 (Journal of Laws 2014, item 827, as amended).

  2. In case of withdrawal from the agreement, the Buyer is obliged to return the Goods within 14 (fourteen) days. The cost of returning the Goods is borne by the Buyer.

  3. The right to withdraw from the agreement does not apply if the original packaging of the product is damaged, making it impossible to return the product due to its specific nature.

  4. The above right also applies to an individual – Entrepreneur with Consumer Rights, entering into an agreement directly related to their business activity, where it is evident from the agreement that it does not have a professional character for this Entrepreneur, as determined by the subject of their business activity available in the Central Register and Information on Business Activity.

VII. Returns and Complaints

  1. Liability for Non-Conformity of Goods with the Agreement
QULE Sp. z o.o. is liable to the Consumer and Entrepreneur with Consumer Rights for any non-conformity of the Goods with the sales agreement existing at the time of delivery and disclosed within two years from the date of delivery or the expiration of the minimum durability of the Goods.
QULE Sp. z o.o. assumes this liability in accordance with the provisions of the Act of May 30, 2014, on consumer rights (Journal of Laws 2022, item 2337).

  2. Complaint Procedure
A complaint can be submitted by the Consumer or Entrepreneur with Consumer Rights in the following ways:

  3. Complaint Resolution Period
Complaints submitted by Consumers or Entrepreneurs with Consumer Rights will be resolved within 14 days from the date of receipt. The decision regarding the complaint will be communicated to the Buyer via email or another agreed method of communication.

VIII. Delivery

  1. Orders placed before 1:00 PM are processed on the same day. Orders placed after this time will be processed the following business morning.

  2. Qule makes every effort to ensure that orders are delivered quickly and safely. However, the Company is not responsible for damaged, lost, or delayed shipments unless a prior written agreement states otherwise.
